New Window Safety Laws

Commercial Law

The Minister for Fair Trading recently announced new safety measures to prevent children falling from windows.

All windows above the ground floor in existing residential strata schemes are to be retrospectively fitted with a lock or safety device which prevents the window opening more than 12.5cm.

The NSW Government will amend the Strata Schemes Management Act 1996 and the Residential Tenancies Act 2010 to require Owners Corporations to install safety devices on all windows that pose a safety risk to young children, all owners to install safety devices regardless of the by-laws of the strata scheme and to include window safety devices in the prescribed condition report for rental premises.

The implementation of new legislation and new safety measures could save a child’s life.
